CONDIZIONI GENERALI DI VENDITA

Art. 1 – Accettazione delle condizioni generali di vendita e conclusione del contratto

Il contratto stipulato tra Ricamificio Filottranese Group srl (di seguito “Idivinity.it”) e il Cliente (ossia il soggetto, persona fisica, che effettua l’acquisto sul Sito, non riferibili alla propria attività commerciale, imprenditoriale o professionale) deve intendersi concluso con l’accettazione, anche solo parziale, dell’ordine da parte di Idivinity.it. Nel caso di mancata accettazione dell’ordine, Idivinity.it provvederà a darne in ogni caso tempestiva comunicazione al Cliente.

Effettuando un ordine nelle varie modalità previste, secondo il form di ordine presente sul Sito (di seguito l’”Ordine”), il Cliente dichiara di aver preso visione di tutte le indicazioni a lui fornite durante la procedura d’acquisto e di accettare integralmente le presenti condizioni generali (di seguito le “Condizioni”).

Le presenti Condizioni possono essere stampate o salvate su supporto durevole, nel rispetto di quanto previsto dall’art. 12 del D.Lgs. 70/2003 e dall’art. 51 del D.Lgs. 206/2005, così come modificato dal D.Lgs. 21/2014.

Art. 2 – Modalità di acquisto

I prodotti offerti in vendita da Idivinity.it sono unicamente quelli presenti sul Sito di Idivinity.it al momento dell’inoltro dell’Ordine, così come descritti nelle relative schede informative.

Resta in ogni caso inteso che le immagini a corredo della scheda descrittiva di un prodotto sono ad esclusivo scopo informativo e possono non essere perfettamente rappresentative delle sue caratteristiche ma differire ad es. per colore e dimensioni (anche in ragione del browser e del monitor utilizzati per l’accesso al Sito e la visualizzazione delle immagini).

Il Cliente per effettuare un Ordine dovrà compilare in ogni sua parte il relativo form presente sul Sito ed inviare il medesimo dopo aver attentamente visionato le Condizioni, nonché le caratteristiche del prodotto e/o dei prodotti che intende acquistare. Il Cliente dovrà altresì richiedere a Idivinity.it, ove la desideri, l’emissione di fattura fiscale relativa all’acquisto, ai sensi dell’art. 22 D.p.R. n. 633/1972.

La corretta ricezione dell’Ordine è confermata da Idivinity.it mediante una risposta via e-mail, inviata all’indirizzo di posta elettronica comunicato dal Cliente. Tale messaggio di conferma riporterà sinteticamente le condizioni di acquisto, come previsto dalla normativa applicabile, nonché i dati inseriti nell’Ordine dal Cliente, affinché lo stesso possa verificare gli stessi ed eventualmente comunicare senza ritardo le necessarie correzioni di dati errati.

Art. 3 – Prezzi e Modalità di pagamento

I prezzi indicati sul Sito sono da considerarsi comprensivi di imposte ed in particolare dell’IVA. Eventuali costi di spedizione o spese di pagamento vengono in ogni caso comunicati preventivamente al Cliente attraverso il Sito o le presenti Condizioni.

Sono previste le seguenti modalità di pagamento:

PayPal

Per il pagamento può essere utilizzato dal cliente il circuito Paypal secondo le modalità specifiche dello stesso

Carta di credito

Nei casi di acquisto della merce con modalità di pagamento Carta di Credito, la transazione potrà avvenire attraverso il server sicuro del gateway di pagamento prescelto da Idivinity.it. In nessun caso e in nessuna fase del pagamento Idivinity.it sarà in grado di conoscere le informazioni relative alla carta di credito del Cliente, trasmesse tramite connessione protetta direttamente al Sito dell’istituto bancario che gestisce la transazione. Nessun archivio informatico di Idivinity.it conserverà tali dati e pertanto in nessun caso Idivinity.it potrà essere ritenuta responsabile per l’eventuale uso fraudolento e indebito di carte di credito da parte di terzi all’atto del pagamento

Art. 5 – Diritto di recesso

Ai sensi dell’art. 52 del D. Lgs. 206/2005, così come modificato dal D.Lgs. 21/2014, il Cliente potrà recedere dalle Condizioni e pertanto dal contratto di acquisto per qualsiasi motivo, senza necessità di addurre motivazioni e senza alcuna penalità, entro 14 (quattordici) giorni lavorativi dalla data di ricevimento dei prodotti.

Per esercitare il diritto di recesso di cui al precedente articolo 5.1, Cliente dovrà inviare a Idivinity.it una comunicazione in tal senso, entro i termini indicati, al seguente indirizzo email customercare@idivinity.it .

In caso di recesso il Cliente dovrà reinviare il prodotto entro 14 (quattordici) giorni dal recesso medesimo, al seguente indirizzo:

Il reso per i residenti in Italia ha un costo di 10 €, di 20 € in Europa mentre non è consentito negli USA e in Russia.

La merce dovrà essere restituita integra, completa di tutte le sue parti e negli imballi originali (buste e confezioni), custodita ed eventualmente adoperata per il tempo strettamente necessario per stabilirne e verificarne natura, caratteristiche e taglia, secondo la normale diligenza, senza che vi siano segni di usura o sporcizia, nel rispetto delle condizioni di seguito riportate:

  • il diritto di recesso potrà applicarsi al prodotto acquistato nella sua interezza; non è infatti possibile esercitare recesso solamente su parte del prodotto acquistato (es.: accessori, complementi, ecc…);
  • perché il recesso sia possibile, il prodotto dovrà essere integro e restituito nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria: etichette, cartellini, tags, sigilli, ecc…);
  • la spedizione, fino all’attestato di avvenuto ricevimento nel magazzino indicato da Idivinity.it è sotto la completa responsabilità del cliente;
  • in caso di danneggiamento del bene durante il trasporto, Idivinity.it ne darà comunicazione al Cliente, per consentirgli di sporgere tempestivamente denuncia nei confronti del corriere da lui scelto ed ottenere il relativo rimborso; il prodotto sarà quindi messo a disposizione del Cliente, contemporaneamente annullando la richiesta di recesso;
  • Idivinity.it non risponderà in nessun modo per danneggiamento, furto, smarrimento occorsi durante o comunque in dipendenza della spedizione per la restituzione.

Idivinity.it provvederà a rimborsare al Cliente l’intero importo già pagato, entro 14 (quattordici) giorni dal recesso, tramite procedura di storno dell’importo addebitato, utilizzando lo stesso mezzo di pagamento utilizzato dal Cliente per la transazione iniziale, salvo diverso accordo. Idivinity.it potrà sospendere il rimborso sino al ricevimento del prodotto restituito ovvero sino al momento in cui il Cliente dimostri di aver correttamente rispedito il prodotto, se precedente.

In ogni caso, il Cliente decadrà dal diritto di recesso nei casi in cui Idivinity.it accerti che:

  • il prodotto restituito e/o i suoi accessori, e/o la sua confezione non sono integri;
  • il prodotto è mancante della sua confezione esterna e/o dell’imballo interno originale;
  • il prodotto è mancante di elementi integranti lo stesso e/o accessori

Nel caso di decadenza del diritto di recesso, Idivinity.it provvederà a restituire al mittente il prodotto acquistato, addebitando allo stesso le spese di spedizione e, ove già rimborsato, il prezzo del prodotto.

Art. 6 – Garanzie

Tutti i prodotti venduti da Ricamificio Filottranese Group Srl sono coperti dalla garanzia di 24 (ventiquattro) mesi per i difetti di conformità, ai sensi del Titolo III del D.Lg. 206/2005. Per fruire dell’assistenza in garanzia, il Cliente dovrà conservare la fattura, ovvero la ricevuta di pagamento, unitamente al documento di trasporto.

La garanzia per difetti di conformità si applicherà purché il relativo prodotto sia stato utilizzato correttamente, nel rispetto della sua destinazione d’uso.

Nel caso in cui, per qualsiasi ragione, Idivinity.it non fosse in grado di rendere al Cliente un prodotto in garanzia (ripristinato o sostituito), ovvero ove la riparazione o la sostituzione fossero, anche in ragione del valore del prodotto, eccessivamente onerose, Idivinity.it potrà procedere alla congrua riduzione del prezzo pagato, ovverosia alla restituzione dell’intero importo pagato con risoluzione del contratto.

Nei casi in cui l’applicazione delle garanzie preveda la restituzione del prodotto, lo stesso dovrà essere restituito dal Cliente nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria).

Art. 7 – Reclami e richiesta di informazioni

Ogni eventuale reclamo o richiesta di informazione potrà essere indirizzato a Idivinity.it ai seguenti recapiti.

Art. 8 – Privacy

I dati personali raccolti con l’inoltro dell’Ordine verranno trattati da Idivinity.it al solo fine di soddisfare le espresse richieste del Cliente, nel rispetto del D.Lgs. 196/2003 e successive modifiche dell’informativa privacy presente sul Sito. Eventuali ulteriori trattamenti verranno effettuati unicamente con l’espresso consenso del Cliente.

Art. 9 – Legge applicabile

Il contratto di vendita di cui alle presenti Condizioni e la relativa esecuzione e regolato dalla Legge Italiana, con la disapplicazione delle norme di conflitto e della Convenzione delle Nazioni Unite per la Vendita Internazionale di Beni. Per la soluzione delle relative controversie sarà competente il Tribunale del comune di residenza del Cliente.

Art. 10 – Copyright

Marchi, loghi e altri segni distintivi presenti nel Sito appartengono ai rispettivi proprietari. E’ vietato l’uso di marchi, loghi e altri segni distintivi inclusa la riproduzione su altri siti internet da parte di terzi non autorizzati. I contenuti del Sito sono protetti dal diritto di autore (testi, immagini e grafica).

Art. 11 – Accordo

Il contratto sostituisce tutti i precedenti contratti, accordi e intese intercorsi tra le parti e costituisce l’intero accordo tra le parti in merito all’oggetto del contratto, insieme all’ordine, alle condizioni generali relative all’uso del Sito e alle condizioni relative al servizio di registrazione. Ogni variazione o modifica del contratto dovrà essere accettata per iscritto da entrambe le parti.

Art. 12 – Comunicazioni

Tutte le comunicazioni tra le parti dovranno essere effettuate per iscritto e inviate all’indirizzo dell’altra parte indicato nel contratto e nell’ordine. Si intendono inviate per iscritto anche le comunicazioni trasmesse all’indirizzo di posta elettronica dell’altra parte, indicato sul Sito e nell’ ordine. Le comunicazioni relative alla validità o all’esistenza del presente accordo dovranno essere esclusivamente consegnate a mano o inviate a mezzo di lettera Raccomandata con Avviso di Ricevimento.

Art. 13 – Lingua

Il contratto di vendita è redatto in due versioni: italiano e inglese. In caso di difformità nella traduzione prevarrà la versione in lingua italiana.

GENERAL TERMS OF SALE

Art.1-Acceptance of the general conditions of sale and conclusion of the contract

The contract between Ricamificio Filottranese Group srl (hereinafter “ Idivinity.it “) and the Customer (ie the individual, natural person, who makes the purchase on the Site, not related to his business,commercial or professional activity) shall be deemed concluded with the acceptance, even if only partial, of the order by Idivinity.it. In case of non-acceptance of the order, Idivinity.it will provide timely communication to the customer in any case.

Placing an order in the various ways provided, according to the order form on the Site (hereinafter the “Order”), the Customer declares that he has read all the information provided to him during the purchase procedure and that he fully accepts these general conditions (hereinafter the “Conditions”).

These Conditions may be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree no. 70/2003 and art. 51 of Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014.

Art.2-Methods of purchase

The products offered for sale by Idivinity.it are only those present on the Site of Idivinity.it at the time of the Order, as described in the relevant information sheets.

It is in any case understood that the images accompanying the descriptive card of a product are for informational purposes only and may not be perfectly representative of its characteristics but differ eg. by color and size (also due to the browser and the monitor used to access the Site and display images).

In order to place an Order, the Customer must fill in all its parts the relevant form on the Site and send the same after having carefully examined the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer shall also request from Idivinity.it, if desired, the issue of a tax invoice relating to the purchase, pursuant to art. 22 d.p.r. No. 633/1972

The correct receipt of the Order is confirmed by Idivinity.it through an e-mail reply, sent to the email address communicated by the Customer. This confirmation message will summarize the purchase conditions, as required by the applicable legislation, as well as the data entered in the Order by the Customer, so that it can verify the data and, if necessary, communicate the necessary corrections of incorrect data without delay.

Art.3-Prices and payment methods

The prices indicated on the Website are inclusive of taxes and in particular VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the Site or these Conditions.

The following payment methods are available:

Paypal

For the payment can be used by the customer the Paypal circuit according to the specific methods of the same

Credit card

In case of purchase of the goods with Credit card,  the transaction can be made through the secure server of the payment gateway chosen by Idivinity.it . In no case and at no stage of the payment Idivinity.it will be able to know the information related to the Customer’s credit card, transmitted via secure connection directly to the Site of the bank that manages the transaction. No computer archive of Idivinity.it will retain such data and therefore in no case Idivinity.it may be held responsible for any fraudulent and undue use of credit cards by third parties at the time of payment.

Art.4-Delivery of products and associated charges

The products purchased will be delivered to the address indicated by the Customer in the Order within the terms indicated on the Site by the acceptance of the Order by Idivinity.it at the cost specifically indicated on the Site before sending the Order. When activated, Idivinity.it reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries outside the Italian borders, shipping costs and delivery times may vary.

With regard to deliveries requested in countries outside the European Union, any customs import charges will be charged to the recipient. The Customer is therefore invited to contact the customs authorities of his country in advance to verify the costs and any import limits. The delivery times indicated by Idivinity.it must be considered as purely indicative and a delay with respect to the same, or any delivery made with subsequent fractional shipments do not entitle the Customer to the refusal of the delivery and the request for compensation or indemnification.

Average delivery times are:

For Italy are 3/5 working days depending on the region.

For the EU 3/7 working days depending on the country.

Other countries: DHL 3/7 working days, EMS 7/15 working days depending on the country of destination and the stay in customs of the parcel.

The delivery times indicated by Idivinity.it must be considered as purely indicative and a delay with respect to the same, or the possible delivery made with subsequent fractional shipments do not entitle the Customer to the refusal of the delivery and the request for compensation or indemnification.

At the time of delivery of the products, the customer is required to check:

• that the number of packages delivered corresponds to what is indicated in the accompanyng document.

• that the packaging is intact, not damaged, nor wet or otherwise altered, even in the closing materials (adhesive tape or metal straps).

Any damage to the packaging and/ or the product or the mismatch of the number of packages or indications, must be immediately detected, with a specific indication on the delivery document of the product to be returned to the courier.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in the manner provided in this document.

Art.5- Right of withdrawal

Pursuant to art. 52 of D. Lgs. 206/2005, as amended by Legislative Decree no. 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

To exercise the right of withdrawal referred to in the previous article 5.1, Customer must send to Visionary84.it a communication to that effect, within the terms indicated, to the following email address: customercare@Idivinity.it 

In case of withdrawal, the Customer must return the product within 14 (fourteen) days of the withdrawal to the following address:

The return for residents in Italy has a cost of 10 €, 20 € in Europe while it is not allowed in the USA and Russia.

The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, under normal due diligence, without signs of wear or dirt, in accordance with the following conditions:

• the right of withdrawal may apply to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, complements, etc…);

• for the withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessories: labels, tags, seals, etc…);

• the shipment, until the certificate of receipt in the warehouse indicated by Idivinity.it is under the full responsibility of the customer;

• in case of damage to the goods during transport, Idivinity.it will inform the customer, to allow him to file a timely complaint against the courier chosen by him and get the refund; the product will then be made available to the customer, simultaneously cancelling the withdrawal request;

• Idivinity.it will not be liable in any way for damage, theft, loss occurred during or in any case depending on the shipment for the return.

Idivinity.it will refund to the Customer the full amount already paid, within 14 (fourteen) days of withdrawal, through cancellation procedure of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. Idivinity.it may suspend the refund until receipt of the returned product or until the moment when the customer proves to have correctly returned the product, if previous.

In any case, the Customer shall waive the right of withdrawal in cases where Idivinity.it ascertains that:

• the returned product and/or its accessories and/or its packaging are not intact;

• the product is missing its outer packaging and/or the original inner packaging;

• the product is missing elements and/or accessories (e.g. laces, patches, etc.).

In the event of forfeiture of the right of withdrawal, Idivinity.it  will return the purchased product to the sender, charging the same shipping costs and, if already refunded, the price of the product.

Art.6-Warranty

All products sold by Ricamificio Filottranese Group Srl are covered by the 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of Legislative Decree no. 206/2005. In order to benefit from the warranty assistance, the Customer must keep the invoice, or receipt of payment, together with the transport document.

The warranty for lack of conformity will be applied provided that the relevant product has been used correctly, in compliance with its intended use and with the provisions of the instructions for use and washing present in and/or with the product.

In the event that, for any reason, Idivinity.it is not able to return to the customer a product under warranty (restored or replaced), or if the repair or replacement are, also because of the value of the product, excessively expensive, Idivinity.it  will be able to proceed to the fair reduction of the price paid, that is to the restitution of the entire amount paid with termination of the contract.

In cases where the application of the guarantees provides for the return of the product, the same must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

Art.8-Privacy

The personal data collected with the forwarding of the Order will be processed by Idivinity.it for the only purpose of satisfying the express requests of the Customer, in compliance with Legislative Decree no. 196/2003,as amended and the privacy policy on the Site. Any further processing will be carried out only with the express consent of the Customer.

Art.9-Applicable law

The sales contract referred to in these Conditions and its execution and regulated by Italian Law, with the application of the conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the municipality of residence of the Client will be competent for the settlement of the related disputes.

Art.10-Copyright

Trademarks, logos and other distinctive signs on the Site belong to their respective owners. The use of trademarks, logos and other distinctive signs, including reproduction on other websites by unauthorized third parties, is prohibited. The contents of the Site are protected by copyright (texts, images and graphics).

Art.11-Agreement

The contract replaces all previous contracts, agreements and arrangements between the parties and constitutes the entire agreement between the parties on the subject of the contract, together with the order, the general conditions relating to the use of the Site and the conditions relating to the registration service. Any variation or modification of the contract shall be accepted in writing by both parties.

Art.12-Communications

All communications between the parties must be made in writing and sent to the address of the other party indicated in the contract and in the order. Communications sent to the e-mail address of the other party, indicated on the Site and in the order, are also intended to be sent in writing.

Communications relating to the validity or existence of this Agreement shall be delivered exclusively by hand or sent by registered letter with Acknowledgement of Receipt.

Art.13-Language

The contract of sale is drawn up in two versions: Italian and English. In case of discrepancy in the translation will prevail the Italian version.
